Chris Brown's Request To Dismiss DC Assault Trial Gets DENIED By Judge; DC Trial Moves FORWARD

Chris Brown, who has been in Jail in L.A since March 17th, was transported by US Marshals on the notorious prisoner-preferred "Con Air" flight over the weekend to Washington DC. He was due in court today in the assault trial for punching a man in the face outside the W Hotel back in October.

Despite trying to avoid going to trial and now currently in the hands of the U.S. Marshals Service, the 24-year-old singer missed his first hearing this morning, however, Judge Patricia Wynn moved forward and denied Chris' request to dismiss the case.

As previously reported, the Grammy-award-winning singer's lawyers argued the case should be dismissed because prosecutors abused the grand jury process to prepare for trial.

Brown's lawyer, Mark Geragos, said prosecutors used the grand jury to "freeze" the testimony of the alleged victim in the case, a man who says Brown and his bodyguard punched him outside a Washington hotel, reports ABC NEWS.

The judge agreed with prosecutors, saying "they had a right to use the grand jury to assess the strength of their case." "I am persuaded that there was no abuse," Wynn said.

Geragos called the incident "the most investigated misdemeanor of all time."

According to reports, Brown will be spending his days in DC at the federal holding facility in San Bernardino. Brown and his bodyguard are scheduled to go to trial on April 17. A judge will hear the case, not a jury.

Brown's lawyers and government prosecutors are expected to return to court Monday afternoon for an additional hearing. Issues to be discussed include whether Brown and his bodyguard, Christopher Hollosy, should be tried separately, which their lawyers want.

Prosecutors, meanwhile, want the judge to bar Brown from claiming self-defense. A court document says the man Brown and Hollosy are accused of hitting was treated for a fractured nose and injuries to his face and head. The two allegedly punched the man after he tried to get in a picture Brown was taking with two of the alleged victim's female friends.

DID YOU KNOW? At the time of the alleged assault in Washington, Brown was on probation for attacking his ex-girlfriend Rihanna in California in 2009. Soon after his arrest in Washington, he took the easy way out -- avoiding jail time -- by entering a rehab facility for anger management treatment.

Too bad, Chris' good boy behavior was short lived, he was jailed in mid-March after violating the facility's rules and for allegedly dating one of the staff workers.

If convicted in the Washington case, Brown could face additional penalties, including time behind bars, under the terms of a court order in the Rihanna case.
